The late payment process stemmed from past billing practices that were approved by Ontario Hydro (Toronto Hydro's regulator at the time). For its part, Ontario Hydro did notify Toronto Hydro to stop charging the late payment charge in the manner that it was being applied when it became known that the charge could violate the maximum amount of interest allowed under the Canadian Criminal Code.

Toronto Hydro never profited from this practice; late payment costs that were collected effectively lowered utilities' revenue requirement which kept customer rates lower.  That is, all ratepayers benefited.

Similarly, Toronto Hydro will not profit from collecting money now -- all of the money (net of legal and related costs) that is being sought to recover will be passed on to Winter Warmth: a charity that aids low income customers with their winter heating bills.
